The Chaps PA Company Terms And Conditions Of Hire
1.1. The Customer means the person, firm or company contracting for the hire services of the Company.
1.2. Equipment means any machine, article, tool, and/or device together with any accessories
specified in a Contract which are hired to the Customer;
1.3. Charges will represent the money paid to Chaps PA for goods hired.
2.1. The equipment remains the property of Chaps PA unless the issue of an invoice which stats that the equipment has been purchased.
2.2. All fees mentioned are subject to UK VAT
2.3. The customer holds full responsibility of the equipment once in his possession.
2.4. Extensions of hire must be notified to the Owner at least 24 hours before the end of the original hire period.
3.1. All the charges for hire will be specified to the customer before the delivery is made.
3.2. If the hirer fails to make any payment in full on the due date Chaps PA Hire may charge the hirer interest (both before and after judgment) on the amount unpaid at the rate of
4% above the base rate. Such interest shall be compounded with quarterly rests.
3.3. Charges will be imposed if the equipment is returned damaged or stolen.
3.4. Cancelled sessions (after confirmation) are subject to the charges if Chaps PA Hire have been unable to fill the time with alternate bookings
3.5. The customer agrees to pay Chaps PA for every additional day the equipment is not returned
3.6. Any fuses or lamps replaced during the period of hire need to be returned to Chaps PA, otherwise charge is imposed.
4. Customers responsibility
4.1. The customer responsibility starts after receiving the equipment and ends after it has been received.
4.2. The customer will keep and maintain the equipment at all times
4.3. The customer shall not in any circumstance lease, disperse or sell the equipment
4.4. No condition in this clause will have an effect of the statutory rights of the clients.
4.5. The customer shall only use the equipment hired for the purpose mentioned in the agreement.
4.6. Customer is not allowed to repair or tamper with the equipment unless guided by Chaps PA Hire representative.
5. Theft and damage to the equipment
5.1. All the equipment issued by Chaps PA hire are always in good condition. Incase they are damaged at delivery report at once
5.2. Full fees are charged in case the equipment are damaged or stolen during the time of hire.
5.3. The customer shall notify immediately in case the equipment hired is damaged or stolen.
5.4. The agreement can be terminated by Chaps PA Hire of the equipment has been reported stolen or damaged
6. Compatibility of equipment
6.1. The customer has to ensure the devices used are compatible with the equipment hired by Chaps PA.
6.2. The customer has to ensure the equipment are used for the purpose they are designed to
7. Liablity and Insurance
7.1. The customer shall keep the equipment insured against fire, loss, damage or risk from whatever cause arising in the full replacement value thereof and will permit the Owner at all reasonable times to have access to the equipment and to inspect the state and conditions thereof.
7.2. The customer shall notify its insurers that the equipment is on hire from the COMPANY and shall ensure that the Hirers insurance company endorses the policy with such interest naming the company as payee.
7.3. The customer is to provide liability insurance for stealing or damage to the equipment.
7.4. The customer shall not settle any claim made in respect of this agreement against its insurance policy without the express consent of the company.
7.5. Customer’s liability for breach of any of these provisions herein shall be limited to £1,000,000.
7.6. The Customer accepts liability personal injury, which is due to the sole negligence of operation.
7.7. The customer accepts liability for the loss of or damage to the equipment due to the negligence of the hirer and/or its representatives using the equipment on its behalf.
Chaps PA shall be entitled to levy the following charges in the event of a cancellation
8.1. Cancellation 60 days or less prior to hire period start 25% of total hire charge
8.2. Cancellation 30 days or less prior to hire period start 50% of total hire charge
8.3. Cancellation 7 days or less prior to hire period start 100% of total hire charge
9. Return of the goods
9.1. The goods should be retuned at the date specified in the delivery note
9.2. The equipment shall be returned by the customer in a good and clean condition.
9.3. The customer agrees to pay charges in case the above clause does not hold.
10. Termination of hire.
10.1. Chaps PA may cancel the contract if the customer:
10.1.1. Breaches the terms of the contract
10.1.2. End of the contract
10.1.3. The customer does not pay for the services within fourteen days.
